Property Conveyance 

Legal representation by a qualified real estate lawyer and assistance is particularly advisable in Spain, when purchasing or selling property. 

The conveyancing process involves different degrees of participation by the various parties involved: the seller, their legal representative, the real estate agent, the notary, the registrar, utility companies, the town hall where the purchase is being made, the banks and in some cases, the local courts, regional authorities and even the seller's neighbours they may even have something to say, in case of first option to by rights.

The real estate lawyer will ensure that all parties are appropriately co-ordinated and followed up, and will perform an investigation to ensure that the property is purchased without any previous charge or liability that could incur additional costs or reduce the property’s value.

We provide all the services to clients who are buying and/or selling property in Spain, to help clients calculate their budget from the outset. We can also assist clients in putting them in touch with local estate agents, local banks and mortgage brokers, so that all aspects of their transaction can be covered.

We are specialists in property law, but also in construction and planning law. This difference is essential, because we are ready to discover, not only the registration information from the property, but other essential aspects related with its construction and/or its administrative situation as: Has the property been build with all permits and licenses?, Does it respect the construction law?.... These are the points that we, as masters in construction, consider essential.

Our services start making a previous legal checking of the property, the land, and the construction of the property (checking the legal and the administrative situation ). For this, we apply for the information about the property at the Town Hall, and other local institutions where the property is placed, talking to architects and inspectors of the area. The reason of this is to obtain an exact legal situation of the property for construction, licenses, building permits, etc. With this, we will guaranty our clients that there will not be any actions against the property as construction fines, demolition orders, etc., in the public institutions regarding any eventual illegal construction, or any work over the building.

Our Conveyancing Service includes:

— Obtain the NIF (taxpayer's number)

— Complete all necessary searches on the legal status of the property and the developer/vendor, informing the buyer/s of any issues discovered that may influence the decision or conditions of the purchase.

— Liaise and agree with vendor/s and/or lawyers in respect of the terms and conditions of the purchase, ensuring compliance with current laws. In the event that the vendors are non-resident in Spain, a lawyer ensures that any amount paid prior to completion is lodged safely.

— Make preparations for completion of the purchase or any further preparations required relating to the purchase such as; preparation of the power of attorney for individuals abroad (duly legalised and translated) which give authority to a physical person/s to act on behalf of the buyers.

— Assist in the completion process and ensure title deeds are properly registered in the appropriate local Land Registry, and that the property (ies) is free from all charges and encumbrances, free from occupants and tenants, as well as payment of the relevant taxes associated with the purchase.

— Assist in locating, negotiating and obtaining a mortgage loan to finance the purchase of the property. The obtaining of the mortgage may be in the form of an approval in principle prior to the signing of the private purchase contract and is understood without prejudice to any other mortgage facility provided by the developer or the vendor.
